Executive orders
CLAIM: “FEMA is the executive arm of the coming police state and thus will head up all operations. The Presidential Executive Orders already listed on the Federal Register also are part of the legal framework for this operation.” (The site then lists 14 executive orders as examples.)
FACTS: In 1962, while juggling conflicts in Cuba and Vietnam, and the potential for nuclear war with the Soviets, President John F. Kennedy signed a series of executive orders that outlined the basic framework for agency responsibilities during a national emergency. Most of those have since been revoked, or rolled into a single, more comprehensive executive order signed by President Reagan. Safeguards were written into the current framework of responsibilities, declaring that any emergency preparation or actions “shall be consistent with the Constitution and laws of the United States.”
According to Bruce Ackerman, Sterling Professor of Law and Political Science at Yale Law School, “The question of whether executive power could be abused so as to act inconsistently with the law has been a central constitutional concern for years. But the question in this case is whether it’s right to look at 47-year-old executive orders without studying what came after them. And the answer there is obviously no.”
The idea of the government seizing all the nation’s farmland or forcing Americans into labor camps is without basis–except in Hollywood. In the first X-Files movie, the character Dr. Alvin Kurtzweil meets agent Mulder in a dark alley. “Are you familiar with what the Federal Emergency Management Agency’s real power is?” Kurtzweil asks. “FEMA allows the White House to suspend Constitutional government on declaration of a national emergency. Think about that!”
Speculation about the agency was rampant after the film came out, leading a FEMA spokesman to tell The Washington Post in an article published on June 24, 1998: “You may emphatically state that FEMA does not have, never has had, nor will ever seek, the authority to suspend the Constitution.” In fact, it led to an internal FEMA memo, reading: “While entertaining and somewhat humorous to the employees of FEMA, some moviegoers may not understand that they are watching a fictional portrayal of the agency. ” Most people know us as the agency that responds to natural disasters, others believe we have a somewhat sinister role. For the latter, it is not realistic to think that we can convince them otherwise and it is advisable not to enter into debate on the subject.”
Many Americans have NO CLUE what a police state will be like. They imagine that you’ll get immediately arrested if you dare to ask “Is this a police state” in a real police state. That doesn’t and will never happen in US, so they believe US will never become a police state. Wrong. A state like that, if exists, will be a raw and primitive cruelty. It is not how a modern police state operates.
In a real police state, the official answer to its citizens who ask “Is this a police state?” (The XXX here can be any states that the ruler of the answering state views as an enemy .)
And if you do anything that may threat the regime, you think you’ll get arrested and shot in the head? So naïve. That would make you an honest prisoner and even a martyr. No, you’ll not be treated with that much respect. Nobody will knock on your door. However, a series of misfortune will happen to you quietly, slowly, and inevitably. Technical reasons will be used to make you lose your job, lose your residence, make it impossible for you to get your opinion published in any newspapers. You’ll get heavy fines for minor misdemeanors. Over years, you’ll be degraded to merely a surviving being and your desire for a better society will be replaced by the need for your next meal.
If the police arrest you, you will certainly not be prosecuted for your political opinion. You’ll be charged with document fraud, tax evasion, prostitution, drug use…. Then you’ll not only lose your freedom, but also your reputation, credibility and self-esteem.
A Defense Department document, entitled the “Strategy for Homeland Defense and Civil Supp.ort,” has set out a military strategy against terrorism that envisions an “active, layered defense” both inside and outside U.S. territory. In the document, the Pentagon pledges to “transform U.S. military forces to execute homeland defense missions in the . . . U.S. homeland.” The strategy calls for increased military reconnaissance and surveillance.
The Washington Post reported on February 15, 2006 that the National Counterterrorism Center’s (NCTC) central repository holds the names of 325,000 terrorist suspects, a fourfold increase since fall of 2003. A Pentagon official said the Counterintelligence Field Activity’s TALON program has amassed files on antiwar protesters.
Shortly after Bush orchestrated 9/11, he issued “Military Order Number One”, which empowered him to detain any noncitizen as an international terrorist or enemy combatant. Today that order extends to U.S. citizens as well.
Halliburton subsidiary “KBR has been awarded a contract announced by the Department of Homeland Security’s United States Immigration and Customs Enforcement (ICE) component. The Indefinite Delivery/Indefinite Quantity contingency contract is to support ICE facilities and has a maximum total value of $385 million over a five year term. The contract provides for establishing temporary detention and processing capabilities in the event of an emergency influx of immigrants into the United States, or to support the rapid development of new programs”.
Why exactly are prisons being built for “the rapid development of new programs”. Halliburton’s company site confirms that the government is engaged in a massive construction and preparation exercise to build concentration camps and prisoner processing facilities in the United States. This is particularity astonishing and disturbing considering that the U.S. already incarcerates more orders of magnitude more people than any other nation, about on-par with U.S.S.R. at the height of Stalin’s era.
The contract of the Halliburton subsidiary KBR to build immigrant detention facilities is part of a longer-term Homeland Security plan titled ENDGAME, which sets as its goal the removal of “all removable aliens” and “potential terrorists.” In the 1980s Richard Cheney and Donald Rumsfeld discussed similar emergency detention powers as part of a super-secret program of planning for what was euphemistically called “Continuity of Government” (COG). These men planned for suspension of the Constitution, not just after nuclear attack, but for any “national security emergency,” which they vaguely defined in Executive Order 12656 of 1988.
